Terms of Service

These Terms of Service (“Terms”) govern your use of ESGFlux.com (“ESGFlux”, “Service”, “we”, “us”, or “our”), operated by Austen Plummer from Dubai, United Arab Emirates. By creating an account or using the Service, you agree to these Terms.

1. The Service

ESGFlux is a regulatory intelligence platform that aggregates publicly available ESG (environmental, social, and governance) regulatory updates from official sources, applies AI summarisation, and delivers curated digests and alerts to subscribers.

2. Account registration

You must be at least 18 years old and authorised to represent your organisation to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity on your account. Notify us immediately of any unauthorised access.

3. Subscriptions and billing

  • Subscriptions are billed monthly in advance through Paddle, our Merchant of Record. Applicable VAT/sales tax is added at checkout based on your location.
  • New accounts may receive a free trial. No payment is taken until the trial ends.
  • Subscriptions renew automatically until cancelled. You can cancel at any time via the billing portal; access continues until the end of the paid period.
  • Refunds are handled at our discretion within 14 days of the initial purchase. Pro-rated refunds for cancellations mid-period are not provided.
  • We may change prices with at least 30 days’ notice. Existing subscriptions continue at the original price until the next renewal.

4. Acceptable use

You agree not to:

  • Share your account credentials with unauthorised users or exceed the seat limits of your plan.
  • Redistribute, resell, or republish content from the Service without written permission.
  • Scrape, reverse engineer, or automate access beyond documented API endpoints.
  • Use the Service to transmit malicious code or violate applicable laws.
  • Interfere with the Service’s security or infrastructure.

5. Content and intellectual property

The Service aggregates publicly available regulatory content and adds our own AI-generated summaries, metadata, tags, and editorial selection. Our summaries, platform, software, and branding are our intellectual property.

The underlying regulatory texts remain the property of their respective publishers (regulators, government bodies). We provide links to original sources and do not claim ownership of their content.

You are granted a non-exclusive, non-transferable licence to use the Service for your organisation’s internal compliance purposes while your subscription is active.

6. No legal or financial advice

ESGFlux is an information service, not a legal, tax, or financial advisory service. AI-generated summaries and categorisations may contain errors or omissions. You must not rely on the Service as a substitute for qualified professional advice. Always verify critical information against original regulatory sources before making compliance decisions.

7. Service availability

We aim to keep the Service available 24/7 but do not guarantee uninterrupted access. We may perform maintenance, apply updates, or temporarily suspend access. Enterprise plans may include a separate Service Level Agreement.

8. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim arising from your use of the Service is limited to the fees you paid in the 12 months preceding the claim. We are not liable for indirect, consequential, or punitive damages, including lost profits, compliance penalties, or missed regulatory deadlines.

9. Termination

You may cancel your subscription at any time. We may suspend or terminate your account if you breach these Terms, fail to pay, or misuse the Service. Upon termination, your access ends and your data is retained per our Privacy Policy.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email at least 30 days before taking effect. Continued use of the Service after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of the United Arab Emirates. Disputes will be resolved in the courts of Dubai, UAE. Nothing in this clause limits statutory consumer rights you may have under the laws of your country of residence.
